Conditions of Use
1) GENERAL AGREEMENT
By placing a binding order, the buyer commits to accept the Conditions of Use for product delivery as they are set by the seller. The relationship between the buyer and the seller is follows the Conditions of Use which are binding for both sides.
2) ORDERING PRODUCTS AND SERVICES
We offer you the opportunity to shop directly from your home where you can shop nonstop. You can easily and conveniently place the order using the shopping cart, your phone number, your e-mail address, or by writing to our address.
The objects of the contract are only the products included in the buying contract—order. Dimensions, weight, performance, capacity, and other specifications stated on our website, in our catalogues, leaflets, and other printed materials are non-binding specifications based on the information provided by manufacturers. If there are any discrepancies, we will, of course, contact you.
We commit to deliver to our customers only such products that are in exactly the conditions stated in their descriptions and according to their age, fulfilling the specifications or typical properties for the given product compliant to norms, regulations and directives valid in the Czech Republic.
For the electronic order to be valid, you must provide all the required data in the order form. At the same time, the order is a buying contract proposal. The buying contract is ensued by the product delivery. To make a buying contract, the formal order has to be confirmed by the seller. In individual, especially price-wise more complicated cases, the seller reserves the right to make the contract by order confirmation ideally in person or via phone, and the right to require a down payment from the buyer.
If, during the time when the product is ordered, there appears a significant change in the exchange rate, or a change in the price of the products set by the distributor, our company reserves the right to change the order after an agreement with the buyer or to cancel the order completely and immediately. We also reserve the same right in case the manufacturer stops supplying the ordered product or places a new version of the product on the market, or changes the price of the product significantly.
3) ORDER CONFIRMATION
An order is accepted within 24 hours, we will send you an order confirmation via e-mail, we will also send you an e-mail notification after the shipping. If there are any doubts, we will, of course, contact you.
4) ORDER CANCELLATION
You can cancel the order within 24 hours via phone or e-mail without stating any reasons. Just give us your name, e-mail and the description of the ordered product or service.
5) PACKING AND SHIPPING FEES
We will send you the ordered products cash-on-delivery via the post or a delivery company. If you are on our delivery list, we will let you know about the delivery via phone or e-mail. The price of shipping is calculated automatically during the order completion, and is based on up-to-date pricelists of respective delivery companies, and is based particularly on the dimensions and weight of the ordered products.
6) DELIVERY TIME
The estimated delivery time is 2—7 days, unless stated otherwise. If the products are not in stock, we will contact you immediately.
7) WARANTY CLAIM AND WARRANTY
The products offered by our company have exclusively the status: used / second hand, and the seller is therefore not obliged to provide the standard warranty as it is typical for new products, based on law regulations in the Czech Republic. Despite that, in order to prove the high standards of our services, our company ensures a 30-day warranty for the buyer to install and test the item or component, and in that way to test its functionality. Please, read carefully item descriptions and see the photographs which are never illustrative, and should introduce and describe the item to the buyer to inform him about the item’s status and wear ratio. That way we can avoid unnecessary complications and trouble adding to often exhausting repair care about our darlings, and subsequent arguments. We are not responsible for the damage caused by delivery companies.
Warranty does not apply to:
a) the damage caused by common using
b) the damage and defects caused by an incompetent installation
c) inadequate storing
Warranty claim procedure:
1) Inform us about the warranty claim via phone, e-mail or letter
2) after arranging the warranty claim with us, send the product as a registered package (not cash on delivery) to our address
3) state the reason for the warranty claim and your address in the package
4) a receipt proving that the product for which you are claiming warranty was bought in our shop
we will review your warranty claim as soon as possible within 30 days since its beginning, i.e. since delivering the product to our company.
Product replacement by the customer’s request (not a warranty claim)
Product replacement by a request of the customer is possible only if both sides agree on it, and Motovraky Ltd. reserves the right to charge such a transaction a handling charge equivalent to 20% of the price of the item which the customer wants to replace. The reason is simple. It happens that the customer orders a component only supposing that it will fit to a different type of a motorcycle than from which our company states it was obtained. The item then arrives and it does not fit. Billing, packing, submitting the package, and the e-shop manipulation are the operations connected to selling and included in the 20% charge for replacing a product, not caused by the seller.
